Introduction
Web Power bv supplies the email marketing platform DMdelivery. Web Power
bv prohibits DMdelivery customers from sending unsolicited email. This prohibition comprises any form of unsolicited
bulk email and commercial email, also known as spam. The prohibition applies to customers, the customers of customers
as well as customers who provide services enabling spammers to send unsolicited email.

Definition
Web Power bv defines unsolicited bulk email and commercial email as email sent
to recipients who have neither requested nor have an expectation of receiving such email from the specific sender. This
includes advertisements, promotional campaigns, questionnaires, brochures, sale of email addresses, promotion of
website URLs, and sales information and auctions.
The policy
Web Power bv's customers and, where applicable, their customers, are not
allowed to use the software on Web Power bv's network for sending unsolicited email. Senders of mailings and the like
are obliged to keep a record proving that the recipients have explicitly asked to receive the email or material in
question. The absence of such records may be interpreted unconditionally as a failure to have obtained the required
explicit permission.
Web Power bv's customers shall adhere to this policy and will ensure that their customers, resellers, managers and
service providers do likewise. The customer may be held responsible for all traffic to or outside Web Power bv's
network resulting from unsolicited email. It is the customer's responsibility to ensure that he/she does not promote
himself/herself by means of unsolicited email.
If Web Power bv receives a complaint, this will be submitted to the client with the objective of receiving feedback as
well as a solution to the problem. If this feedback and the corresponding solution to the problem, the sending of
unsolicited email, are not received within 24 hours, Web Power bv is authorised to suspend the customer's connectivity
until such time that Web Power bv is convinced that the incident has been completely remedied and measures have been
taken to prevent the future sending of unsolicited email. The customer is responsible for all unsolicited email sent
over his or her connection via Web Power bv.
Customers whose connection to Web Power bv is used to send unsolicited email will be disconnected immediately, subject
to a period of 2 hours during which the customer is offered the chance to stop sending the unsolicited email
(batch).
Implications for practical use
Customers are obliged to inform their respective
customers and users with regard to unsolicited email in order to make sure that they also adhere to the anti-spam
policy stated above.
Customers of Web Power bv are obliged to handle fully and properly any received complaints with regard to unsolicited
email.
If you use a mailing list, you are obliged to verify whether the recipients of these mailings have expressed an
interest in receiving the mailing or have explicitly agreed to receive the information in question.

an improved, more efficient and cost-effective use of the Internet as a means of communication. This will allow us to
provide better services to our customers, which is ultimately our mission.
